Get Rolling SM Sweepstakes Official Rules 1. NO PURCHASE NECESSARY. MAKING A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. "Get Rolling" Sweepstakes (the "Sweepstakes") starts September 15, 2008 and ends October 24, 2008 ("Sweepstakes Period"). Specially-marked “Get Rolling” Sweepstakes Promotional Cups (“Promotional Cup(s)”) containing code words required to enter online will be available at participating Bowling Centers until October 23, 2008 or whenever supplies are exhausted, whichever occurs first. Approximately 2,000 Centers are expected to participate. Two ways to enter: a) online with purchase of 44 ounce drink in Promotional Cup at participating Bowling Centers; or b) by mail, without purchase of any kind. See Rule 3, below, for complete details of each entry method. 2. ELIGIBILITY: Sweepstakes is open to legal residents of the 50 United States and the District of Columbia who are 18 years of age or older (19 or older if a resident of AL or NE) at the time of entry. Sweepstakes is void elsewhere and where prohibited by law. Employees of Strike Ten Entertainment, Strike Ten Promotions, Bowling Proprietors Association of America, the participating bowling centers, Orange County Choppers Inc. (“OCC”), their respective affiliates, subsidiaries, printers, advertising and promotion agencies and the officers, directors and agents of each of the foregoing (collectively, the "Sweepstakes Entities"), and members of the immediate families (defined as spouse, mother, father, sisters, brothers, sons and daughters, and each of their respective spouses) or households (whether related or not) of any of the above, are NOT eligible to participate. 3. HOW TO ENTER, DRAWING, PRIZE DESCRIPTIONS AND ODDS OF WINNING: b) Entry By Mail: No Purchase Necessary. To enter without making a purchase, hand-print your name, address, city, state, zip code, age and home telephone number on a 3” x 5” card or piece of paper and mail it, in a #10, business-size envelope with proper postage affixed to: “Get Rolling” Sweepstakes, PO Box PO Box 922491, Norcross GA, 30010. Entries must be postmarked by October 24, 2008 and received by October 31, 2008. No mechanically reproduced or photocopied entries allowed. Limit one entry per envelope. Limit one entry per household per day regardless of the entry method. Entries become the property of the Sponsor, and will not be acknowledged or returned, except as provided herein. Proof that you submitted an entry does not constitute evidence that it was actually received. DRAWING - - On or around November 3, 2008, the Sponsor will conduct a random drawing to select the one (1) Grand Prize winner from among all eligible entries received from both entry methods combined. GRAND PRIZE – One (1) Grand Prize will be awarded, consisting of an Orange County Chopper Custom Made “Strike Bike” Chopper. The “Strike Bike” is a custom made bowling-themed chopper-style motorcycle (“chopper”) exclusively designed by Orange County Chopper for this Sweepstakes. The approximate retail value of the Grand Prize is $75,000. Winner must accept chopper as designed; no further customization allowed. Winner is solely responsible for all applicable income taxes, insurance costs, surcharges, registration, title, and license fees and other costs incurred in registering or using the chopper. Any chopper displayed or pictured in promotional/advertising materials in connection with this Sweepstakes may not be the actual chopper awarded. Actual chopper may vary in appearance. Failure to accept possession of chopper within thirty (30) days of notification of availability may result in prize forfeiture. Odds of winning the Grand Prize depend upon the number of eligible entries received from both entry methods combined. 4. The Grand Prize may not be transferred, substituted or redeemed for cash except as provided herein. Sponsor may substitute a prize of equal or greater value if the advertised prize becomes unavailable. All federal, state and local income taxes on the prize are the sole responsibility of the Grand Prize winner. Winner will be issued an IRS Form 1099 for the value of the prize. 5. PRIZE CONDITIONS: Potential Grand Prize winner will be notified by phone and/or mail and will be required to complete and return an Affidavit of Eligibility, a Liability Release and, where permitted, a Publicity Release ("Affidavit/Release") . Affidavit/Release must be returned within the time indicated on the documents. If Affidavit/Release are not returned within that time, or if notice is returned as undeliverable, or if the selected entrant is found to be ineligible, or if he/she does not comply with the Official Rules in any way, then such potential Grand Prize winner will be disqualified and the Grand Prize will be awarded to an alternate winner chosen at random from among the remaining eligible entries received. 6. Sponsor and Strike Ten Promotions (“Administrator”) are not responsible for late, lost, damaged, misdirected, incorrectly addressed, incomplete, illegible, undeliverable, destroyed, or postage-due entries. Sponsor and Administrator are further not responsible for (i) electronic transmissions or entries that are lost, late, stolen, incomplete, illegible, damaged, garbled, destroyed, misdirected or not received by Sponsor/Administrator or their respective agents for any reason, (ii) any problems or technical malfunctions, errors, omissions, interruptions, deletions, defects, delays in operation or transmission, communication failures or human error that may occur in the transmission, receipt or processing of entries, or for destruction of or unauthorized access to, or alteration of, entries, (iii) failed or unavailable hardware, network, software or telephone transmissions, damage to entrants’ or any person’s computer and/or its contents, or causes beyond Sponsor’s/ Administrator’s reasonable control that jeopardize the administration, security, fairness, integrity or proper conduct of this Sweepstakes, or (iv) any entries submitted in a manner not expressly allowed under these rules; all such entries will be disqualified. All incomplete or non-conforming entries will be disqualified. The Sponsor and Administrator do not assume any responsibility for any disruption in the Sweepstakes caused by labor strikes, or any other act, circumstance or other unforeseen event outside of the control of the said parties. Entry material/data that has been tampered with or altered is void. If there is a dispute about to whom the email address or online entry belongs, the entry will be deemed to be submitted by the authorized account holder of the submitted email address. “Authorized account holder” is defined as the natural person who is assigned to an email address by an Internet Access Provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE THE WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND/OR CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO DISQUALIFY AND SEEK ALL REMEDIES AND DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING CRIMINAL PROSECUTION. Sweepstakes is subject to all applicable federal, state and local laws and regulations. By participating in this Sweepstakes, participants agree to be bound by these Official Rules and the decisions of Strike Ten Promotions, which shall be final in all matters relating to the Sweepstakes. By entering, entrants also agree to release, discharge, indemnify and hold harmless the Sweepstakes Entities from and against any claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from or in connection with the acceptance, possession, misuse and use of the prize (if applicable) or participation in the Sweepstakes or in any Sweepstakes-related activity or any typographical or other error in the printing, offering or announcement concerning this Sweepstakes. Except where prohibited by law, accepting the prize constitutes permission for the Sweepstakes Entities to use the Winner's name, likeness, statements, biographical information, voice, and/or address (city and state) worldwide and in all forms of media, including but not limited to the Internet, in perpetuity, without notice, limitation, review or further compensation. 7. If for any reason the Sweepstakes cannot be executed as planned, including but not limited to transmission failure, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor or Administrator that corrupt or affect the security, administration, fairness, integrity or proper conduct of this Sweepstakes, or if the Sweepstakes is compromised or becomes technically corrupted in any way, electronically or otherwise, Sponsor reserves the right to terminate the Sweepstakes and may award the prize in a random drawing from among all eligible, valid entries received as of the date/time of termination. No automatic, programmed, robotic or similar means of entry is permitted and individuals engaging in such practices will be disqualified. The use of automated or third party software or web site to enter is prohibited and will result in disqualification from the Sweepstakes. By participating in this Sweepstakes promotion, participants give their express permission to be contacted by Sponsor by telephone, e-mail and/or postal mail, as permissible, for Sweepstakes purposes and for purposes relating to special offers. 8. DISPUTES: By participating in this Sweepstakes, each entrant agrees that any and all disputes, claims, and causes of action arising out of or connected with the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Texas. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, participants’ rights and obligations, or the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance, with federal law and to the extent not inconsistent, the laws of the State of Texas. In the event there is a discrepancy or inconsistency between disclosures and other statements contained in any Sweepstakes materials and the terms and conditions of these Official Rules, these Official Rules shall prevail, govern, and control. 9.
